Welcome to Partyu App! These Terms of Use ("Terms") constitute a legal agreement between you ("User", "you") and Perfsoft Soluções em Desenvolvimento de Software LTDA ("Partyu", "we", "our"), which governs the use of the Partyu App mobile application and all related services.
By downloading, installing, accessing, or using the Partyu App, you declare that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use our services.
You also declare that you are at least 18 (eighteen) years of age or the legal age of majority in your jurisdiction, whichever is greater.
Partyu App is a marketplace platform that connects event organizers with participants, offering:
Partyu acts as a technological intermediary and is not responsible for the organization, quality, or realization of events published on the platform.
To use certain features of the Partyu App, you must create an account by providing true, accurate, current, and complete information. You are responsible for maintaining the confidentiality of your access credentials.
You are entirely responsible for all activities conducted on your account. Notify us immediately if you suspect unauthorized use of your account via email [email protected].
Each individual or legal entity may maintain only one account on Partyu App. Creating multiple accounts may result in the cancellation of all associated accounts.
Partyu App has two main user profiles:
Users who create and manage events on the platform. Organizers can opt for subscription plans that determine their event creation capabilities and applicable fees.
Users who discover events, purchase tickets, and participate in events. Any registered user can act as a participant.
We offer different subscription plans for event organizers, each with specific benefits and limitations. Plan details, including prices and features, are available in the application.
Subscriptions are processed through app stores (Apple App Store and Google Play Store) as in-app purchases. Billing is recurring according to the chosen period (monthly or annual).
You can cancel your subscription at any time through your app store settings. Cancellation will be effective at the end of the current billing period, and you will retain access to benefits until that date.
We reserve the right to change plan prices. Changes will be communicated in advance and applied only to new billing periods.
Organizers are entirely responsible for the information provided about their events, including name, date, location, description, and ticket price. It is prohibited to create events with false, misleading, or illegal information.
Public events are visible to all users on the "Explore" screen. Private events are accessible only through links shared by the organizer.
Ticket purchase is processed securely through Stripe. By purchasing a ticket, you agree to the specific terms of the event defined by the organizer.
The refund policy is defined by each event organizer. Partyu is not responsible for refunds, which must be handled directly with the organizer. In case of event cancellation by the organizer, the refund will be processed automatically.
Each ticket has a unique QR Code that must be presented at event entry. The ticket is valid for single use and cannot be duplicated or transferred without authorization.
All ticket payments are processed by Stripe. Partyu does not store complete credit card data.
Partyu charges a fee on each ticket sale, which varies according to the organizer's plan. Fees are automatically deducted from the sale amount before transfer to the organizer.
Ticket sale amounts, minus applicable fees, are transferred to organizers through Stripe Connect according to Stripe's policies.
By using Partyu App, you agree NOT to:
Partyu App, including its design, code, logos, trademarks, and original content, is owned by Perfsoft and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without express authorization.
You retain ownership of content you publish on the platform (texts, event images, etc.). By publishing content, you grant Partyu a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the services.
You are responsible for ensuring that you have the necessary rights to any content you publish, including images and texts.
Partyu acts exclusively as a technological intermediary between organizers and participants. We are not responsible for the quality, safety, legality, or realization of events published on the platform.
We do not guarantee that the service will be available uninterrupted or error-free. We may perform scheduled or emergency maintenance that temporarily affects availability.
To the maximum extent permitted by law, Partyu will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Our total liability to you for any claim related to these Terms shall not exceed the total amount paid by you to Partyu in the 12 (twelve) months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Partyu, its directors, employees, and partners from any claims, damages, losses, costs, and expenses (including attorney fees) arising from:
You may terminate your account at any time through the application settings or by contacting us. Termination does not affect pending obligations, such as payments due.
We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, engage in fraudulent activities, or harm other users or the platform.
After termination, you will lose access to your account and associated data. Tickets already purchased will remain valid for their respective events.
We may modify these Terms at any time. Significant changes will be communicated through the application or by email at least 30 (thirty) days in advance. Continued use of the service after changes constitutes acceptance of the new Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Partyu regarding the use of the services.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to third parties.
Partyu's failure to exercise any right under these Terms does not constitute a waiver of that right.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be resolved in the courts of Jacareí, State of São Paulo, to the exclusion of any other, however privileged.
